Fourth Offense DWI:
Possible Penalties
- Up to 18 months incarceration by the New Mexico Department of Corrections*
- Up to a $5000.00 fine
Mandatory Prison Time
*Felony Sentences are served in State Prison Facilities rather than county or local jails.
Mandatory Penalties
- Obtain an Interlock License for life
- Have an Interlock Device installed on all vehicles driven by the offender for Life (Offender may apply for restoration of license and removal of the interlock after five years if not subsequently convicted of DWI. Driver must demonstrate good cause. Good Cause may include alcohol screening and proof from interlock vendor that person has not had violations of the interlock device)
- Complete alcohol or drug abuse screening and court approved treatment
- While in Custody, Offender shall be provided substance abuse counseling and treatment
- While on probation or parole, mandatory substance abuse counseling and treatment
